Sale Apartment Bangalore in Street View: drag to look around.
These two readings of the same property carry different weight depending on your situation as a seller, and that is what needs identifying first.
The owner of an apartment in Bangalore often sees it through the price originally paid, the reputation of the developer or the spectacular rise the city has seen over fifteen years. The buyer, meanwhile, weighs it against the new launches started in the same area, which offer staged payments, current facilities and the protections of the RERA legislation. Between those two readings lies the gap that decides whether a resale closes in a few weeks or a listing stays online for a whole season. In Bangalore, the seller of a second-hand flat therefore has to prove what a new project cannot offer: a finished building, clean title and an owners' association that works. The three contrasts below sum up what you are really handing over and what the buyer is prepared to pay.
The price per square foot advertised in the listings in your areavsThe price a buyer accepts when a developer's new project stands next door
The portals often show prices for recent projects or the hopes of optimistic sellers, not concluded sales. The buyer of a second-hand property generally expects a discount against new stock, unless your building makes up for it through location, condition or the absence of any waiting time for possession. Having genuinely registered comparable sales from your own development to hand stops you setting a price nobody will follow.
The super built-up area written into your original agreementvsThe real usable floor area, the carpet area, that the buyer and their bank measure
In India, flats were long sold on an area that included a share of corridors, lobbies and common facilities, appreciably larger than the space inside the walls. Since the RERA legislation, developers have had to state the carpet area, and buyers now compare on that basis. A price per square foot calculated on the older measure therefore looks more attractive than it is, and the buyer will recalculate it for themselves.
The steady rent your tenanted flat brings invsThe value of the same property sold with vacant possession to an occupier
A tenanted flat near the technology parks speaks to investors, who think in yield and negotiate accordingly. A property with vacant possession can also reach families and young couples who want to live in it, often more sensitive to condition and to the school next door than to the rent. Choosing between selling tenanted and selling vacant therefore changes the audience, the timetable and what becomes of the deposit paid by the tenant.
Selling in Bangalore: which seller's situation is yours?
Whatever your situation, the sale follows Indian practices that surprise an owner used to a European process.
An expatriate leaving India, an owner managing a flat from another country and an heir who receives a tenanted property do not sell under the same constraints. Your tax residence status in India determines the withholding the buyer will apply to the price, and your position under the foreign exchange rules governs who you may sell to and how the money can be moved out. A landlord must also work around a lease in progress and a deposit to be returned. Identifying your profile before handing the sale to an agent stops you fixing a price or a date that will not hold. The three cases below set out what changes in practice for each.
Selling before you go
If you live in the flat and plan to leave India, the date of the sale matters as much as its price. While you are still tax resident in India, the buyer deducts only a limited amount from the payment, and you have your local bank account to receive the money. Once you become a non-resident, the withholding applied by the buyer rises sharply, the price has to pass through a non-resident account and the transfer abroad follows a heavier procedure.
For a foreign national who acquired the property while resident in India, the question of transferring it and repatriating the proceeds after departure deserves particular examination with your authorised dealer bank. In practice this argues for starting the sale several months before you leave, allowing for the preparation of the title file, the marketing period and the legal check run by the buyer. Have your timetable validated by a chartered accountant before you appoint an agent, because a few weeks either way can tie up a large share of the price.
Selling from another country
Selling from abroad is perfectly possible: the agent arranges viewings, your advocate prepares the file and checks the sale agreement, and an attorney holding a power of attorney can represent you at registration. The time difference is workable, but you need to decide in advance who negotiates in your name and within what limits of price and conditions.
Two financial points dominate for a non-resident seller. The buyer must deduct tax from the payment, often on the whole price in the absence of a lower deduction certificate, which locks up a substantial sum until your Indian return is processed. The gain must also be declared where you are tax resident, under the double tax treaty that applies to you, and repatriating the money goes through an NRO account and the supporting documents the bank requires.
Selling an occupied or inherited property
A tenanted flat can be sold with the tenant in place, which mainly interests investors attracted by a documented rent. You then have to settle what becomes of the security deposit, often large in Bangalore, either by returning it to the tenant or by transferring it to the new owner through a clear clause. Selling with vacant possession means respecting the notice set out in the lease, generally granted for eleven months, and arranging viewings with the tenant's agreement.
For an heir, the sale starts with bringing the title up to date: a deed of partition or a probated will depending on the case, a no-objection letter from the other heirs and transfer of the Khata into the new owner's name. Until those steps are complete, the buyer's advocate and their bank will refuse to approve the transaction. The gain on an inherited property is calculated by reference to the date and cost of acquisition of the deceased, which is why those records are worth gathering from the outset.
Selling in Bangalore when you are used to another market: agent, advocate and sub-registrar
With those practices in mind, the next question is where, and to whom, your flat will sell most easily across the metro area.
An owner used to selling in many European markets expects an agency mandate, a preliminary contract drawn up before a notary, a statutory cooling-off period for the buyer and technical surveys supplied upfront. In Bangalore, the sale rests on agents paid by commission, a sale agreement negotiated between the parties and their advocates, then a final deed registered at the sub-registrar's office. No public officer guarantees the validity of the title: it is the buyer's advocate, and often the bank's, who examines it over several decades. The seller's obligations therefore centre less on technical surveys than on a complete and consistent title file. The four differences below show what that means for your sale.
From abroad
A written selling mandate, open or exclusive, paid according to the agency's published fee scale
Bangalore
Agents often instructed several at a time, without exclusivity, paid a negotiated commission and registered with RERA Karnataka
Putting your property into the hands of many intermediaries can multiply contradictory listings and blur the asking price. Choose one or two agents, check their registration and set out in writing the commission, the period and the floor price you will accept.
From abroad
A notary drafts the deed, checks the title, holds the funds and records the transfer
Bangalore
The parties' advocates draft the documents and check the title, then the deed is registered at the sub-registrar's office once stamp duty is paid
It falls to you to appoint your own advocate, who will review the sale agreement, the payment clauses and the tax withholding terms. Appoint them as soon as you list, so they can spot the gaps in the file before the buyer finds them.
From abroad
A preliminary contract followed by a statutory cooling-off period for a private buyer
Bangalore
A token advance, then a sale agreement carrying a more substantial advance, with negotiated terms for its return
There is no statutory cooling-off period comparable to the European one: everything turns on the drafting of the agreement. Spell out what happens to the advance if the buyer's loan is refused or a defect in title appears, and fix a longstop date for registration.
From abroad
A file of mandatory technical surveys handed over when the preliminary contract is signed
Bangalore
A title file: earlier deeds, encumbrance certificate, Khata, property tax receipts, occupancy certificate and an association no-dues letter
The buyer rarely commissions a detailed technical inspection, but their bank will refuse the loan if a document is missing. An incomplete file does not merely lower the price: it rules out every buyer who needs to borrow.
Which Bangalore neighbourhoods sell, to whom and how fast?
Knowing who is looking in your area prepares the ground for the figures: the level at which a flat is actually advertised in Bangalore.
In Bangalore, a flat does not find the same buyer in the busy streets of Indiranagar, near the technology parks of Whitefield or in the planned southern districts such as Jayanagar. Each area attracts a dominant profile, whether engineers working on the big campuses, rental investors, families settled for decades or non-resident Indians preparing a return. That profile determines what actually sells: travel time to the office, the reputation of the school nearby, the reliability of water and power, or the standing of the developer. Speed of sale depends less on the district itself than on the fit between your property and what its buyers are looking for. The three cards below describe what the buyer comes looking for, the type of seller or property that moves well there, and the trade-off that weighs on the price.
Indiranagar and Koramangala
The buyer is after a central address, cafes, restaurants, start-ups and a lively street life within a reasonable distance of the offices.
Suits
Sellers of well-placed flats in mid-sized buildings, sought after by young professionals and founders for whom location outweighs facilities.
Trade-off
Buildings here are often older and less equipped than new stock on the edge of the city; the state of the common areas and parking weigh heavily in the negotiation.
Whitefield and Electronic City
The buyer is after immediate proximity to the technology parks, a gated development with a pool and a back-up generator, and international schools a short drive away.
Suits
Landlords selling a two or three bedroom flat let to campus employees, and owners in developments by well-known builders.
Trade-off
New supply is plentiful here: a second-hand flat competes directly with recent launches, which calls for a coherent price and a faultless file.
Jayanagar and Banashankari
The buyer is after the calm of a planned district, tree-lined streets, traditional markets, good schools and an established community.
Suits
Sellers of spacious family flats, often sold to local families or to non-resident Indians who want to come back near their relatives.
Trade-off
Buyers here are demanding about title and the age of the building; an ageing block or an incomplete Khata is negotiated hard against renovated stock.
What an apartment sells for in Bangalore: reading the figures as a guide to your asking price

Price does not tell the whole story: you still need to know exactly what you are handing over with your flat and its share of the land.
The figures below are estimates drawn from listings: they show the levels at which Bangalore apartments are offered, not the net sum you will bank. For a seller, the most useful benchmark is the line matching your number of bedrooms, set against the real area of your flat and its district, checking whether the listing you compare with quotes carpet area or an area including the common parts. A property advertised well above the price per square metre for its category has to justify it through location, a respected builder, the floor it sits on or a better condition, or it will simply stay online. Keep in mind too the guidance value set by the Karnataka administration for your address, because a declared price well below it can have tax consequences. Commission, legal fees, tax and the amount withheld at source then come off the price achieved.

What you actually hand over with a Bangalore apartment: title, share of land and association
These elements shape the price, but one rule matters more still before you appoint an agent or accept an advance.
Selling an apartment in Bangalore is not merely handing over a built volume: it is transferring a registered title, an undivided share of the land and membership of the owners' association that runs the development. In Karnataka, flat ownership is governed by specific apartment ownership legislation, and the original deed normally states the share of land and the rights over the common parts attached to your unit. What the buyer pays for is those documented rights, and anything your file does not prove will be deducted from the price. Some items pass automatically to the new owner, others remain your responsibility until registration. The two panels below separate what transfers from what stays with you.
What transfers with the apartment
The registered sale deed transfers to the buyer your flat, its undivided share of the land, your rights over the common parts and, where they are allotted, the parking space and any reserved areas. The buyer becomes a member of the owners' association and takes on the rules of the development; the corpus fund paid at the outset generally stays with the association and is not refunded to you. A lease in progress can also pass across if the property is sold tenanted, together with the matching security deposit.
What it changesThe buyer will assess your development as much as your flat; gather the original deed stating the share of land, the association's rules and the state of its accounts before you list.
What remains your responsibility until registration
Until the final deed is signed you remain liable for municipal property tax, association maintenance charges and the electricity and water bills, and you must produce receipts proving they have been paid. It also falls to you to have any mortgage discharged, to obtain the return of the original documents from your bank and to supply an up-to-date encumbrance certificate. Transfer of the Khata into the buyer's name happens after the sale, but it assumes yours is in order.
What it changesA Khata in the wrong name, arrears of property tax or an undischarged mortgage are enough to block the buyer's loan; have your advocate check those three points before the first viewing.
The rule to understand in Bangalore before you appoint an agent or set a price
Once that chain is clear, the full course of the sale becomes readable, from listing to the final transfer of funds.
The most expensive rule to ignore concerns neither presentation nor negotiation, but the link between the declared price, the administrative guidance value and your tax status. In Karnataka, every address carries a guidance value that serves as the minimum base for stamp duty, and Indian tax law can substitute that value when computing your gain if the declared price falls well below it. Your status as an Indian tax resident or a non-resident then determines the scale of the amount the buyer will withhold from the payment. Any suggestion that part of the price be paid in cash, outside the deed, finally exposes you to penalties and distorts the whole calculation. Each step in the chain below follows from the one before, and it is better walked through before you appoint an agent than after you have taken an advance.
You decide to put your Bangalore apartment on the market and discuss a price with the agent.
You look up the guidance value applying to your building with the Karnataka stamps and registration department, because the declared price cannot depart from it without consequence: beyond a tolerance of 10%, the tax authority can substitute that value when computing your gain.
You check your Indian tax residence status as at the expected date of the sale, since it determines whether the buyer applies a light deduction or one calculated at the capital gains rate, often on the whole price.
If you are a non-resident, you have the real gain computed by a chartered accountant and apply to the tax authority for a lower deduction certificate, allowing several weeks before registration.
You set the asking price and the date of the deed by reference to the net sum genuinely available after tax, withholding, commission, legal fees and repatriation, refusing any part of the price paid outside the deed.
The price you accept then matches what you will actually receive, in India and where you live.
How the sale of a Bangalore apartment unfolds, step by step
One question remains for many owners: does a flat sell as well as an independent house in Bangalore?
Selling a flat in Bangalore brings in several parties whose roles do not map onto the European model: you, your advocate, one or two agents, the buyer and their bank, the owners' association, the sub-registrar's office and the tax authority. Between listing and registration you have to allow for the marketing period, the title check by the buyer's advocate and, if they are borrowing, the legal and technical review by their bank. Each party acts at a precise moment, and a document missing at one step pushes back all the rest. The six steps below follow the usual order of a resale. They set out who acts and what you need to watch.
You and your advocate1. Assemble the title file and check your tax positionYou gather the registered sale deed, the earlier deeds, the encumbrance certificate, the Khata, the property tax receipts and the occupancy certificate. Your advocate spots the gaps, and a chartered accountant assesses the gain and the withholding that applies given your residence status.
The estate agent2. Market the property and arrange viewingsThe agent, registered with RERA Karnataka, publishes the listing on the portals, filters enquiries and arranges viewings, often at weekends. Agree with them the commission, the floor price and what information they may pass on, to avoid contradictory listings.
The buyer, their advocate and their bank3. Receive the offer and let the title be checkedThe buyer often pays a token advance to reserve the property, then their advocate examines the chain of title, and the lending bank runs its own legal and technical check. The buyer's advocate sometimes publishes a notice in the press inviting any third party to come forward.
Both parties and their advocates4. Sign the sale agreement and take the advanceThe sale agreement fixes the price, the advance, the payment schedule, the longstop date for registration and the terms on which the advance is returned. It is also where the treatment of the tax withholding, the discharge of any loan of yours and the position of a sitting tenant are settled.
The sub-registrar's office5. Register the final deed and receive the balanceOn the day of registration the buyer pays stamp duty, the parties or their attorneys sign before the sub-registrar with photograph and fingerprints, and the balance is paid by transfer or banker's cheque. The buyer remits the tax withheld and must give you the corresponding certificate.
You, your chartered accountant and your bank6. Declare the gain and repatriate the fundsYou file your Indian income tax return to set off the withholding and recover any excess, then the bank transfers the money abroad on production of the chartered accountant's certificate. If you are tax resident elsewhere, you declare the gain there as well.
Apartment or house in Bangalore: which sells better, and how to sell yours
Knowing how your property sells leads to the decisive question: how much will be left once every cost and tax has come off?
In Bangalore, an independent house on its own plot and a flat in a gated development do not sell on the same logic. A well-placed house in an established district such as Jayanagar, Indiranagar or Sadashivanagar sells first of all on its land, now scarce and expensive in the central areas: even when tired, it interests people who plan to renovate or rebuild. A flat, by contrast, sells on the building it sits in, on the standing of its developer and on the health of its association, and its share of land is not enough to make up for a worn-out structure.
For the seller of a flat, competition is therefore more direct. Developers regularly launch new projects along the main corridors and near the technology parks, with current facilities and staged payments. Against them, a second-hand flat has to make the case for what new stock cannot offer: immediate possession with no risk of delay, an occupancy certificate already issued, a settled community of residents and an often more central location. A completed home holding its certificate is also outside the goods and services tax that applies to sales of homes still under construction, an argument your agent can put forward.
A house generally sells on the area of its plot, the width of the road and its development rights; a flat sells on its paperwork. The buyer asks for the monthly maintenance charge, the state of the reserve fund, the reliability of the generator and the water supply, the real carpet area and the list of works planned by the association. A seller who supplies all of that at the first viewing shortens the negotiation and stops an unanswered worry turning into a discount.
Preparation differs too. A house often needs waterproofing repairs before the monsoon and visible work on the facade; a flat mainly needs light, a neutral and clean interior, good photographs and an uncluttered balcony. Heavy works rarely pay for themselves on a flat whose price stays bounded by recent sales in the same development, whereas fresh paint and fixing any seepage are often enough to reassure.
Finally, timing is not judged the same way. A family selling a house or a large flat takes account of the school calendar, which concentrates part of the demand ahead of the new academic year. A tenanted flat can wait for the end of the lease before being offered with vacant possession to a wider audience. If several comparable flats in your development are on the market at the same time, it can be wiser to hold off for a few weeks, or to stand out through condition and the quality of the file, rather than cutting the price straight away.
What selling an apartment in Bangalore costs: commission, fees, taxes and repatriation
With the figures set out, what remains is what will convince the buyer to pay your price: the daily life they picture from your address.
The price achieved is never the sum you bank: between listing and the final transfer, several items come off it. Some are proportional to the price, such as the agent's commission or the tax the buyer withholds, others depend on the file or on your circumstances, such as legal fees, arrears of maintenance charges or capital gains tax. For an owner tax resident in another country, add the declaration of the gain where you live and the cost of currency conversion when you move the money. Stamp duty and registration fees are, by custom, borne by the buyer, but the way they are calculated influences the price they will accept. The ranges below are indicative, are partly negotiable and should be confirmed by written quotes and by a tax adviser.
Selling and preparation costs for an apartment in Bangalore
Cost item
Estimated amount or range
Who pays, when and why
Estate agent's commission
Often in the region of 1 to 2% of the price, plus goods and services tax
Paid by you on completion of the sale; the rate, the floor price and the terms are negotiated before you hand the property to the agent.
Advocate's and chartered accountant's fees
Variable with the complexity of the file, worth comparing on written quotes
Paid by you; they cover review of the sale agreement, putting the title in order, computing the gain and applying for a lower deduction certificate.
Stamp duty and registration fees
Several per cent of the value, calculated on the higher of the declared price and the guidance value
Borne by the buyer by custom; a price below the guidance value does not reduce their duty and can increase your own tax.
Association charges, property tax and arrears
Maintenance often 4 to 8 INR per sq ft per month, depending on the development
Owed by you until registration; the association generally issues a no-dues letter that the buyer will insist on.
Add the discharge of any loan of yours, small repairs and repainting before viewings, and the return of the security deposit if the property is tenanted and sold with vacant possession.
Capital gains tax and repatriating the proceeds
Item
Mechanism or order of magnitude
What it means for you
Tax withheld at source for a non-resident seller
Deducted by the buyer at the capital gains rate, surcharge and cess included, often on the whole price
Reduced if you obtain a lower deduction certificate before the sale; otherwise set off against the tax due and partly recoverable through the Indian return.
Indian capital gains tax
12.5% without indexation for a property held more than twenty-four months; slab rates below that
Surcharge and cess are added; certain reinvestment exemptions exist under strict conditions and must be validated by a chartered accountant.
The gain where you are tax resident
Declaration generally required; double taxation relieved under the applicable tax treaty
The calculation where you live, its allowances for length of ownership and its social levies do not map onto the Indian computation and should be checked with an adviser.
Moving the proceeds out of India
Transfer from an NRO account up to the annual ceiling set by the Reserve Bank of India
Allow for a chartered accountant's certificate, the online declaration the bank requires and a comparison of exchange rates and fees.
These points depend on your tax residence at the date of the sale, the length of ownership, the source of the funds originally used to pay for the property and your position under the foreign exchange rules; an Indian chartered accountant and a tax adviser where you live should validate the amounts before any decision on price.
An ordinary Tuesday in Bangalore, seen by the buyer you are aiming at
The Vidhana Soudha and its gardens in central Bengaluru — Photo: IM3847 · CC BY-SA 4.0 · Wikimedia Commons
Those arguments count, but a serious buyer will not stop at what your listing shows.
The buyer of an apartment in Bangalore is not paying for square feet alone: they are paying for the day they picture living from your address. Travel time to the technology park, access to the metro, the reputation of the school, proximity to a major hospital and the reliability of water and power are all arguments a listing can lead with, provided they are true of your property. In a city where traffic can double a journey at peak hours, daily life bears directly on the price accepted. Following a typical Tuesday for a working couple with one child shows what your agent should emphasise in the description and during viewings. The stops below turn each moment of the day into a concrete selling point.
07:00The development's water tank and back-up generatorThe buyer wants to know whether the building is connected to the BWSSB municipal water supply or depends on borewells and tankers, and whether the generator backs up the whole flat. If your development is well connected and backed up, say so precisely, because it is one of the first questions asked in Bangalore.
08:00A local school following the CBSE, ICSE or international curriculumFor a family, the distance and the journey to a well-regarded school often counts for more than floor area. Mention the schools within a few minutes, without promising a place, since admissions there are frequently contested.
09:00The nearest Namma Metro stationThe metro network is expanding step by step and has changed the value of certain addresses, notably along the purple line out to Whitefield. A flat within walking distance of a station should say so, with the real journey time to the main employment hubs.
10:00An office in a technology park on the Outer Ring RoadFor engineers and managers on the big campuses, peak-hour travel time is the decisive argument, far more than distance as the crow flies. If your address reaches a major employment hub in a reasonable time, state it with a journey measured at peak hours.
13:00Lunch in a cafe in Koramangala or IndiranagarBeing close to lively districts distinguishes a well-placed flat from an isolated development on the edge of the city. Photographs of the shops, cafes and parks a few minutes away are often worth more than yet another view of the living room.
17:30An appointment at a major private hospital such as Manipal HospitalFamilies and older buyers look at the distance to a leading hospital and to a local clinic. In Bangalore, quick access to a large private institution is a genuine argument, provided you give a verified journey time rather than a simple distance.
20:30Back at the development for the evening in the flatIn the evening the buyer judges the quiet, the security at the gate, the lighting along the driveways and the natural ventilation. A late-afternoon viewing lets you show the real atmosphere of the development and how the shared facilities work after the working day.
What a Bangalore buyer will check that your listing does not mention
What the buyer discovers late, the seller pays for: it is the source of the mistakes many owners only measure afterwards.
A listing leads with the view, the pool and the standing of the development, but a serious buyer, their advocate and their bank will go looking for what it leaves out. In Bangalore, those checks bear above all on the regularity of title and approvals, the real floor area, the water supply and the association's accounts. What they find late, you pay for in renegotiation or in a sale that collapses; what you document early becomes a selling point. Most of these points can be verified in a few days if the file is ready, and in several weeks if it has to be reconstructed. Here are the five things the buyer will check, whether or not you mentioned them.
The type of Khata and whether it stands in your name
The Khata records the property in the municipal register and the payment of property tax, and banks draw a clear line between fully regular properties and the rest. The electronic Khata register is now required in order to register a sale within the municipal limits. A Khata that is missing, irregular or still in the developer's name can rule out every buyer who needs to borrow.
The building's occupancy certificate
This certificate, issued by the competent authority once the building is completed in accordance with the approved plans, reassures the buyer that the construction is regular. Its absence complicates bank lending, permanent utility connections and any future resale. If your development lacks one, the buyer will find out and negotiate accordingly.
The real carpet area behind the advertised figure
The buyer will measure, or have measured, the space inside the walls and compare it with the figure in the listing, often quoted on an area including a share of the common parts. A large gap gives the impression of an inflated price and undermines trust for the rest of the negotiation. Give both figures from the start to keep the initiative.
Where the water comes from and what tankers cost
In several parts of Bangalore, developments depend in part on borewells or tanker deliveries, the cost of which feeds through to the maintenance charge during the dry season. The buyer will ask residents and the association about recent shortages. Statements of charges and a documented connection to the municipal network are papers to produce rather than to keep quiet about.
The association's accounts and the works to come
The buyer will want to know the level of the maintenance charge, whether there are arrears, the state of the reserve fund and the major works in prospect, such as replacing the lifts or waterproofing the terraces. An association in dispute with the developer or poorly run frightens off careful buyers. Better to know all of that before they do and to have a costed answer ready.
The seller's mistakes in Bangalore that surface six months later
Those mistakes lead to a blunter question: when is it better not to sell at all right now?
Looked likeGiving the property to the agent who quoted the highest price, pitched in line with the new launches in the area.
Turned outMonths without a serious offer, during which buyers preferred the developer's new stock next door, then successive reductions that ended up releasing the flat below what the more cautious agents had suggested.
Would have caught itAsking every agent for the sales actually registered in the development or the area, and comparing their valuation method rather than their headline figure.
Looked likeAgreeing that part of the price be paid in cash, outside the deed, to reduce the tax and the buyer's duty.
Turned outThe cash could neither be banked without explanation nor moved abroad, Indian tax law prohibiting payments of that kind above a very low threshold, and the price declared below the guidance value served as the basis for an assessment in any case.
Would have caught itDeclaring the full price in the deed, insisting on traceable bank payments and refusing any proposal to pay outside the deed, whatever advantage is claimed for it.
Looked likeSigning the sale after moving abroad, without anticipating the withholding applied to a non-resident seller.
Turned outThe buyer deducted tax on the whole price, a sum far above the tax actually due stayed locked up until the Indian return was processed, and the plan the money was meant to fund had to be postponed.
Would have caught itHaving the gain computed by a chartered accountant and applying for a lower deduction certificate several weeks before registration, or selling before losing resident status where that is possible.
Looked likeSigning from abroad a power of attorney drawn up in haste in favour of a relative still in Bangalore.
Turned outThe power did not identify the property or the authority to register the sale precisely, it had not been presented for stamp duty within the time allowed, and the sub-registrar refused registration, leaving the buyer threatening to claim their advance back.
Would have caught itHaving the power of attorney drafted by the advocate handling the sale, meeting the legalisation or apostille formalities and the Karnataka presentation deadlines, and confirming it is accepted before fixing the date of the deed.
Who should not sell their Bangalore apartment right now?
With those profiles set aside, the question every owner faces remains: sell now, and at what price?
Selling is not always the best decision, even when an agent quotes a good price. Some documentary, tax or family situations make an immediate sale more expensive than waiting a few months or keeping the property. The costs of selling, the tax withheld, the delay in moving the money and the difficulty of coming back into the Bangalore market one day all have to be set against what the sale genuinely gives you. An incomplete file listed too early, in particular, does not sell for less: it often does not sell at all. Here are three profiles for whom the wiser answer is usually to wait.
The owner whose Khata, occupancy certificate or chain of title has a gap in it
→To put the file right first with their advocate and the municipal administration, then list with complete documents.
Buyers who borrow make up a large share of the market, and their bank will refuse to fund a property with an incomplete file; listing too early attracts only buyers who negotiate that risk hard.
The non-resident who needs the money at home by a fixed date
→To put back signing until a lower deduction certificate is in hand, the right bank account is open and the repatriation timetable has been validated.
A withholding computed on the whole price and a transfer subject to supporting documents can tie up a large share of the sum for months, which undermines the very plan the sale was meant to fund.
The owner selling out of weariness with managing at a distance
→To hand letting and dealings with the association to a serious managing agent first, then look again at selling with a clear head.
The costs of selling, Indian and home-country tax and the constraints on moving money make a rushed disposal hard to undo, whereas a management problem can usually be fixed without selling.
So, should you sell your Bangalore apartment now, and at what price?
Selling an apartment in Bangalore is decided less on a hunch about the market than on three simple checks: what you will net, the moment at which your tax status and your position under the foreign exchange rules make the sale most favourable, and the strength of the title file the buyer and their bank will examine. An asking price consistent with the sales actually registered in your development, rather than with the rates quoted for new launches, draws serious offers in the first few weeks, the period when buyers pay the most attention.
If your deed, your Khata, your occupancy certificate and the association's letters are in order, if the guidance value for your address is known, if your gain has been computed and the withholding anticipated, and if the net sum after commission, fees, tax in India and at home and repatriation suits you, you can appoint an agent knowing exactly where you stand. Set the price from verifiable comparables rather than from the most flattering appraisal, decide in advance the level of offer and the advance terms you will accept, and insist that the full price appears in the deed.
If any of those points remains unclear, taking a few weeks to settle it generally costs less than a sale blocked at registration, a sum tied up by an avoidable withholding or a price cut to compete with new stock. Keeping the property, continuing to let it or postponing the sale are equally legitimate decisions when the figures and the documents are not in place. The Bangalore market will go on welcoming well-prepared sellers, who know exactly what they are handing over and what will be left to them.

Can an owner living abroad sell an apartment in Bangalore?
Yes, but the conditions depend on your status under India's foreign exchange rules. A non-resident Indian or an OCI cardholder may in principle transfer a dwelling to a person resident in India, or to another non-resident Indian or OCI cardholder. A foreign national who acquired the property while resident in India, or who inherited it, falls under more restrictive rules, particularly for repatriating the proceeds. Have your position confirmed by your authorised dealer bank in India and by a professional adviser before signing any sale agreement.
What commission does an estate agent charge to sell an apartment in Bangalore?
No statutory scale fixes agents' commission in Bangalore: it is negotiated before you hand over the sale. It is often in the region of 1 to 2% of the price, and it is common for the buyer and the seller each to pay their own intermediary. Goods and services tax is generally added to the commission invoiced. Check that the agent is registered with the Karnataka real estate regulatory authority and have it set out in writing what is owed if the sale falls through.
What capital gains tax do you pay in India on the sale of an apartment in Bangalore?
The gain is taxable in India whether the seller is resident or not. For a property held for more than twenty-four months, the long-term gain has since July 2024 been taxed at 12.5% without indexation, plus any surcharge and the health and education cess. A short-term gain is added to your other Indian income and follows the slab rates. Certain exemptions exist where the proceeds are reinvested under strict conditions, and an Indian chartered accountant should validate the calculation before you settle on an asking price.
What is the tax withheld at source when the seller is a non-resident?
Where the seller is not tax resident in India, the buyer must deduct tax from the payment and remit it to the tax authority, after obtaining their own deductor number. Failing a document to the contrary, this withholding is often calculated on the whole price at the capital gains rate, surcharge and cess included, which ties up far more than the tax actually due. The seller can apply to the tax authority for a certificate authorising a lower or nil deduction before the sale. For a resident seller, the withholding is much lighter and applies only above a price threshold.
Does the gain on a Bangalore sale have to be declared in your home country?
If you are tax resident in another country, gains made on a property situated abroad generally have to be declared where you live. Double tax treaties commonly give India the right to tax the gain on a property located on its territory, and provide a mechanism for relieving double taxation. The calculation in your country of residence follows its own rules, in particular for any allowance linked to the length of ownership and for social levies. Have a tax adviser where you live check the net figure you can expect before you settle on a price.
How do you repatriate the proceeds of a Bangalore apartment sale?
For a non-resident seller, the price is in principle paid into an Indian bank account of the NRO type. Reserve Bank of India rules then allow funds in that account to be transferred abroad up to an annual ceiling, on production of a chartered accountant's certificate and an online tax declaration. Special rules apply where the property was originally paid for with foreign currency sent from outside India. Compare the fees and the exchange rate offered by your bank as well before converting a large sum.
How long does it take to sell an apartment in Bangalore?
Reselling a flat often takes several months, sometimes three to nine, depending on the starting price, the age of the building and competition from new launches in the same area. Added to that marketing period are the title check by the buyer's advocate and the approval of their bank if they are borrowing. Registration of the deed itself can be done quickly once the file is complete. A title file ready from the day you list remains the surest way to shorten the whole process.
What documents should you prepare before listing an apartment in Bangalore?
The buyer and their bank will ask for the registered sale deed in your name and, generally, the chain of earlier deeds known as the mother deeds. Add to that the encumbrance certificate, the Khata and paid property tax receipts, the building's occupancy certificate and, often, a no-dues letter from the owners' association. If a loan is secured on the property, allow for the bank's closure letter and the return of the original documents. Your Indian tax number, the PAN, will also be required.
Can you sell an apartment in Bangalore with a tenant in place?
Yes, a tenanted flat can be sold, and that option mainly appeals to investor buyers. In Bangalore, residential leases are often granted for eleven months, and the tenant has usually paid a security deposit that is high by European standards. That deposit must either be returned to the tenant or transferred to the new owner through a clear clause in the sale agreement. If you prefer to sell with vacant possession, respect the notice period set out in the lease and the framework of the Karnataka tenancy legislation.
Can the sale be signed from abroad under a power of attorney?
Yes, an absent seller can be represented at registration by someone holding a power of attorney. Signed abroad, that power must in principle be legalised or apostilled in the forms accepted in India, then presented for payment of stamp duty in Karnataka within a limited period after it is received. A power of attorney that is too vague or badly drawn up is a frequent cause of registration being postponed. Have it drafted or reviewed by the advocate handling the sale before you sign it.
